NYS Appellate Division in Franlin County

Hon. Robert G. Main, Jr., Franklin County Judge, has announced that the Appellate Division of Supreme Court, Third Judicial Department, will sit in Franklin County on Friday, September 12, 2008, at 10:00 a.m.

The Appellate Division generally convenes at the Justice Building at the Empire State Plaza in Albany but periodically visits local counties to hold regular sessions of Court. This session in Franklin County, only the second to be held here in the Appellate Division’s 112-year history, will mark the bicentennial of the county which is being observed with a variety of events throughout the year.

It is anticipated that the session will be presided over by Hon. Anthony V. Cardona, Presiding Justice, and that he will be joined by four Associate Justices of the Court. The session will be preceded by a coffee hour at which time the Court will meet with members of the Franklin County Bar Association, the local court staff, and local public officials.

The Court’s formal session, which is open to the public, will follow. The Court will hear oral argument on cases which have been appealed to it from trial courts throughout the 28-county Third Judicial Department. It is anticipated that the Court’s calendar may include some cases of local interest.

The Appellate Division is composed of elected Justices of the Supreme Court from throughout the Third Judicial Department who have been appointed to the Court by the Governor. The Fourth Judicial District, consisting of eleven counties in northeastern New York including Franklin County, is part of the Third Department. Currently, there are two Justices of the Appellate Division from the Fourth Judicial District – Hon. Thomas E. Mercure of Washington County, and Hon. John A. Lahtinen of Clinton County.
